I. From the year 2009 on, when participating in the annual inspection of foreign exchange, enterprises with foreign investment should input all the information in the Information System of Foreign Exchange Administration for Direct Investment (hereinafter referred to as the System) in addition to submitting all the materials in the checklist demanded by the State Administration of Foreign Exchange in the paper form. In view of the time needed for arranging and gathering the data and information, enterprises with foreign investment can submit the materials for annul inspection to the local foreign exchange bureau from March 16, 2009.

II. When participating in the annual inspection of foreign exchange, enterprises with foreign investment should conscientiously, truthfully and completely fill in the Information Registration Form of Joint Annual Inspection on Enterprises with Foreign Investment (Foreign Exchange), which can be downloaded from the on-line service platform of the State Administration of Foreign Exchange (WWW.SAFESVC.GOV.CN). When filled out and stamped with the enterprise’s seal on it, the form should be submitted to the State Administration of Foreign Exchange with audit report of the foreign exchange statement and other paper materials. Meanwhile, enterprises with foreign investment should submit an electronic version of the above form via the System, whose content and data should be exactly the same as the paper version. III. Enterprises with foreign investment should participate in the joint annual inspection that includes the annual inspection of foreign exchange and truthfully provide the demanded information. As for the enterprise with foreign investment that is obliged to participate in the annual inspection but fails to do so, the System shall mark its business status as “Not Participating”, which shall, when the period of annual inspection is over, affect the enterprise to go through the foreign exchange business including opening and using an account, verification of business, putting on record and other afterward work due to the fact that the operation of foreign exchange for direct investment should be processed via the System.

IV. Based on Article 48 in Regulations on the Foreign Exchange System of the People's Republic of China, the State Administration of Foreign Exchange shall give corresponding penalty to the enterprise and the responsible person that do not participate in the annual inspection of foreign exchange or provide demanded information according to the regulations.
