I. With a view to accelerating the development of Nanning Economic and Technological Development Area (hereinafter shortened as NNDA) and enabling NNDA to fully play its leading and model role in Nanning’s economic development, these regulations are formulated in accordance with the relevant national laws and regulations as well as Nanning’s real situation.
II. With the aim of improving the invested foreign investment, developing the modern manufacturing industry and optimizing the export structure, NNDA is a multi-functional comprehensive industrial area that devotes to developing the new and high technology and the high value-added service industry.
III. NNDA shall establish the management system and operational mechanism that conform to market economy, and shall promote system innovation.
IV. With the consent of Nanning Municipal Government, NNDA may adopt the method of many parks in one area for its construction and management.
V. Nanning Municipal Government establishes the Administrative Committee of NNDA that is responsible for the affairs in NNDA.
VI. The Administrative Committee has the legal powers as follows:
i. Compile the economic and social development plans and schemes for NNDA and the master plan and individual plans for the construction of the park(s), and implement the plans with the approval of Nanning Municipal Government.
ii. Construct and manage the infrastructure and public facilities in NNDA.
iii. Take charge of investment attraction and international economic and technological cooperation in NNDA.
iv. Examine and approve different types of investment projects in NNDA within its power limitation.
v. Administer the matters concerning personnel and labor in NNDA and protect the legal rights of the employers and employees.
vi. Administer the social matters of NNDA.
vii. Coordinate and monitor the branches and offices of relevant departments set in NNDA.
viii. Formulate and implement relevant administrative regulations of NNDA.
ix. Exercise other administrative powers authorized by Nanning Municipal Government and other relevant departments.
VII. When needed, the Administrative Committee shall establish the necessary functional departments to exercise the corresponding administrative powers.
VIII. The relevant district governments and the municipal government shall support the Administrative Committee and its work. The functional departments of the Administrative Committee are supervised and guided by the higher-level competent administrative departments.
IX. NNDA shall establish the corresponding fiscal system and the branch of national treasury.
X. The Administrative Committee shall establish the high efficient complaint system to timely solve the problems reported by individuals, legal persons and other organizations.
XI. The Administrative Committee and its staff shall work and provide quality service on the principle of integrity, high efficiency, openness, equality and justice. Neither the Administrative Committee nor its staff shall interfere in the matters that are subject to individuals, legal persons or other organizations.
XII. NNDA and its development have been integrated into the master plan for urban area of Nanning and that for land utilization for centralized management. When it’s necessary to expand its administration or to adjust its location, the Administrative Committee shall submit for examination and approval in accordance with the regulations for national-level economic and technological development area.
XIII. NNDA shall follow the land utilization plan for its land utilization and examine and provide the land in accordance with the procedure set by the state. The project(s) that fall(s) within the encouraged category shall be legally granted the preferential policy of reduction and exemption.
The occupancy rate of land used for newly constructed, transformed and expanded industrial projects, that of the land used for administration and service facilities and other indices shall conform to the relevant requirement of the state.
XIV. The right to use land in NNDA can be compensated by legal means of lease or turning into shares after evaluation. The land can also be used by means of allotment and transfer. Investors can legally develop tracts of land in accordance with the plan of NNDA.
XV. Those who are to develop and construct projects in NNDA shall invest in the funds, commence and complete the construction in accordance with the schedule. When the land is laid idle as a result of failure to invest in funds, to commence the construction or to complete the construction in accordance with the schedule, the case shall be handled according to the relevant regulations for idle land and the contract.
XVI. Enterprises and other projects to be invested and established in NNDA shall conform to the national industrial policies and industrial guidance of NNDA.
XVII.It is encouraged to establish in NNDA the commercial, educational, cultural, sports and health care enterprises and other organizations that conform to the regional plan and industrial guidance.
XVIII. It is encouraged to establish in NNDA the service organizations of finance, insurance, law, accounting, evaluation and consultation.
XIX. It is encouraged to invest, construct and manage the projects of water supply, gas supply, power supply, drainage, road, environmental pollution prevention and other infrastructure. The soft loan can be offered to the infrastructure projects in NNDA.
XX. People with experience of overseas study are encouraged to establish new and high-tech enterprises in NNDA.
Institutions of higher education, research institutes and other enterprises are encouraged to establish new and high-tech enterprises or to carry out projects for commercializing new and high-tech results.
Institutions of higher education, research institutes, other organizations and individuals are encouraged to establish various kinds of service organizations in NNDA.
Multinational corporations are encouraged to establish research and development center, financial center, technology service center, training center, purchasing center, logistics center, operational center and supportive base in NNDA.
XXI. The Administrative Committee encourages various types of senior personnel to start business or to obtain employment in NNDA and provides the senior personnel working in NNDA with support and help in funds for scientific research, their children’s enrollment, professional title accreditation, etc.
XXII. The organizations and individuals that are to establish enterprise(s) in NNDA can contribute as part of the registered capital the intangible assets of patent or non-patent technology that can be valued with currency and can be transferred legally. Such cases can be handled by the investors in accordance with the Company Law.
XXIII. The enterprises in NNDA shall open the account book, submit to the Administrative Committee the accounting statements and statistical statement and accept the supervision by the relevant departments of taxation, industrial and commercial administration, finance, audit and statistics.
Foreign investment enterprises shall employ Chinese registered accountant(s) to verify the annual accounting statement and liquidation accounting statement and prepare the report.
XXIV. The enterprises, organizations and individuals in NNDA must abide by the laws and regulations for environmental protection and execute the regulations for labor protection, safety production and industrial sanitation.
XXV. The enterprises and organizations in NNDA shall practice the minimum payment and social security system, and continuously improve the working conditions to provide the staff with good working environment.
XXVI.The terminated enterprises in NNDA shall be liquidized legally and go through the formalities of cancellation of registration. The liquidized capital of foreign investors can be remitted out of China in accordance with the law.
XXVII. The enterprises and organizations in NNDA can enjoy the preferential policies for:
i. coastal open cities (set by the state);
ii. autonomy in ethnic groups inhabited areas (set by the state and Guangxi);
iii. western area of China (set by the state);and other supportive and encouraging measures set by the Administrative Committee.
Foreign investment enterprises also enjoy the preferential policies for encouraging foreign investment set by the state, Guangxi and Nanning.
New and high-tech enterprises also enjoy the preferential policies for encouraging development of new and high-tech industry set by the state, Guangxi and Nanning.
XXVIII. The industrial and new and high-tech enterprises in NNDA shall pay the administrative charge that have been clearly stated by the state and Guangxi as without exemption or reduction and the governmental specialized funds, and shall be exempted from other administrative charge.
XXIX. NNDA can apply to establish export processing zone, bonded logistics center, export supervision warehouses and bonded warehouses, as required by development.
XXX. Facilities for energy, transportation, environmental protection and other facilities in NNDA shall be integrated in the relevant plan and arrangement of Nanning and be given priority.
XXXI. The Administrative Committee shall develop related social undertakings as required.
XXXII. Nanning Municipal Government can support the construction and maintenance of infrastructure in NNDA with specialized funds or by other means.
XXXIII. This regulation shall take effect on November 1, 2006.
