Case: Mrs. Jiang is a typical online shopper. In early April, Mrs. Jiang purchased a set of light with 1,000 yuan at TMALL.com for her new house. However, seven days passed and she still did not receive the lights. She learned that light bulbs were broken during the delivery. Later the express company compensated double delivery fee to her. “A set of light is worth of 1,000 yuan. However, delivery fee is only 10 yuan and 20 yuan for double. I suffer a great loss.” She said.
Analysis: The new national standard specifies the compensation to express item value loss, lost express item and express item damage due to delivery delay. It follows the principle of “compensation based on agreement or relevant provisions if there is no agreement”. If value-insured fee is paid, the compensation is based on the value-insured amount; If not, the compensation is 1:1 against the express item value according to the Contract Law. That is to say, according to the new standard if Mrs. Jiang encounters the same situation, she could demand for full compensation on the value of the light and be exempted from delivery fee rather than the compensation of double delivery fee.
