Nanning Subsidy Administrative Measure for Hotel Improvement Projects Serving CAEXPO

(Feb. 26th, 2004)

In the light of the “Notice of Some Regulations for Hotel Improvement Project” (ref: Nanning Government No.9 [2004], hereinafter as “Regulations”), certain measures of management have been done for the sake of standardizing the subsidies for hotel improvement project and speeding up the improvement work.

Article 1  The Subsidies for Hotel Improvement Project (hereinafter as Subsidy) will have a concentrative management.

Article 2  The sources of the subsidy will be from:

1.       the special fund arranged by Nanning Municipal finance

2.       the special fund arranged by the Autonomous Government

3.  other special funds.

Article 3   Hotels that enjoyed the use of the Subsidy should meet the following requirements:

1.       those existing hotels, hostels, guest houses and other reception houses (hereinafter as hotels) within Nanning jurisdiction and in Wuming and Yongning Counties.

2.       those hotels listed in 2004 leading hotel improvement program project

3.       those hotels that have been clear of the construction declaration formalities before July 1st, 2004

4.       those hotels that have completed the hotel improvement before Oct. 1st, 2004

5  those hotels that have been checked and accepted by the headquarter of hotel improvement project and related functional departments according to the state standard of “Tourist Hotel Star Rating”GB/T14308-2003and then made available to users.

Article 4  Scopes of Subsidy

1.       for newly increased hotel rooms;

2.       for the room improvement and upgraded;

3.       for the improvement of complete sets (facilities)inside the main building;

4.       for the construction of perfecting the external environment of the hotels (within the red line of hotel layout). Newly built and the under constructed hotels, guesthouses, hostels and reception houses are beyond the subsidy scope.

Article 5  Hotels who have applied for enjoying the preference policy should submit a “Schedule for hotel facilities improvement” to the headquarter before March 10th, 2004.

The contents of the schedule should include: the name of the construction project (the proprietor), legal person, project coordinator and forms of contact; the detail of the construction, total investment, the source of the fund, expected time for the commencement and completion; the prospective star rate after the improvement, numbers of rooms and beds, supporting facilities, business operation, etc.

Hotels should submit “the application for star rating” if they plan to upgrade and get the star rate.

Article 6  The headquarter responsibly issues “Nanning 2004 Project Program for Supporting Hotel Improvement Projects of CAEXPO” and informs the hotels of implementation after getting the approval from the Municipal People’s Government.

Article 7 If the hotels, listed on “Nanning 2004 Project Program for Supporting Hotel Improvement Projects of CAEXPO”, want to apply for the subsidies, they should finish the following work before May 1st, 2004:

1.       the budgetary estimate for hotel facilities improvement work;

2.       to provide the contract agreement signed with Construction Company if it is an engineering construction work, whereas the contract agreement signed with the businesses if it is equipment purchases;

3.       the letters of intent for the loans from the bank or the crediting contract of the bank or the capital certificate for the owned fund;

4.       the certificate issued by the bank for the account special for hotel improvement projects.

Article 8  Nanning Financial Bureau will open a special account for appropriating the Subsidy, and the hotels should also open a special account for the improvement construction project to carry out the special management and accounting.

Article 9  The subsidy calculating standard: the total actual completed investment × one-year loaning interest rate set by the Bank of China × years

The details of the subsidy calculating standard:

1.         The subsidy calculating standard for increasing over 15 rooms or one business floor (15 and one floor involved) should be: the total actual completed investment × one-year loan interest rate set by the Bank of China × 3;

2.         The subsidy calculating standard for room rebuilt, supporting facilities and the part rebuilt except those listed in No.1 should be: the total actual completed investment × one-year loan interest rate set the By bank of China × 2;

3.         The subsidy calculating standard for the construction parts for improving the exterior of the main building of the hotels (within the red line region) should be: the total actual completed investment × one-year loan interest rate set by the Bank of China × 1.

Article 10  Hotels permitted to use the subsidies should sign a contract agreement with the headquarter for the hotel facilities improvement project to clarify the liabilities of the both sides.

Article 11  The subsidies procedures should be appropriated as follows:

1.   After getting the first loan from the bank or from the self financing fund, hotels listed in “Nanning 2004 Project Program for Supporting Hotel Improvement Projects of CAEXPO” can get 30% of the subsidy within 5 working days after the items written in Article 7 have been checked by the headquarter and the banking statements cleared through with the bank , and then submitted to the Municipal Financial Bureau for verification.

2.   When the improvement work has been done and checked and accepted before Oct.1st, 2004, the Municipal Financial Bureau will allocate 40% of total subsidy within 5 working days. If the work can’t be finished and accepted before Nov.11th, 2004, the rest of the subsidy will not be allocated at all.

3.   If the hotels can finish their improvement work and get the acceptance before Oct.1st, 2004, they should submit their financial account settlement to the Municipal Financial Bureau before Nov. 1st, 2004 without any delay. After examining and checking, the Financial Bureau of Nanning will allocate the remaining fund according to the account settlement before Dec. 15th, 2004.

Article 12  If any variation in investment plan or construction items occurs, yet, in accordance with the Regulations, the declaration of construction is done before July 1, 2004, the sum of subsidy can be recalculated and examined and approved by the headquarter and Nanning Financial Bureau according to the total investment after the variation. Only one time recalculation of variation can be allowed for each hotel.

Article 13  The checking and acceptance for the finished work should be done timely when the improvement work has been completed. The checking and accepting report should be submitted to the headquarter.

Article 14  If the work has been ceased because of the force majeure or some other reasons, the headquarter will stop the paying of the subsidy.

Article 15  All the construction units (proprietors) should accept the supervision and inspection of the headquarter and Financial Bureau of Nanning during their improvement constructions.

Article 16  Any construction unit (proprietor) who has been permitted to use the subsidy should ensure to finish the work, the project checking and acceptance and be made available to users according to the book of responsibility signed. Financial Bureau of Nanning will stop allocating funds and totally reclaim the allocated funds if the hotel breaks the regulation, resorts to deception, gains by cheating or constructs without regard to the plan and schedule. Meanwhile, the construction unit (proprietor) and the legal person of the project will be called to ascertain wherethe responsibility lies according to law and given legal sanction if they violate the law.
