To ensure the smooth operation of the Green Passage for the Key Investment Attraction Projects, increase the quality and efficiency of the examination and approval and certificates Handling in the green passage, in accordance with Nanning¡¯s Implementation Regulations on Green Passage for the Key Investment Attraction Projects, the operating rules are hereby formulated.
Article 1 At Nanning Administrative Approval and Certificates Handling Hall (hereinafter called Hall), Nanning Municipal Examination and Approval Office shall assign related departments to set up a window of special service, liaison telephone, and full-time contact persons who will be specially responsible for accepting and receiving the certificates handling business for projects to enter the green passage.
Article 2 The Certificates Handling Group of the Office of the Joint Conference on the Green Passage for Key Investment Attraction Projects shall be specifically responsible for organizing and coordinating over 40 commissions, offices, and bureaus in the Hall to jointly handle the certificates. The departments in the Hall shall make sure the procedures for the projects of the green passage go without any hindrance.
Article 3 The project investor or his agent brings the ¡°Green Passage Service Card¡± and other related materials for the examination and approval to the window of special service and puts forward the applications for examination and approval, certificates handling, checking and acceptance, and registration.
Article 4 For the projects of the green passage, the examination and approval at the beginning, certificates handling, or construction application at the latter stage shall be accepted and handled instantly with the coordination of the certificates handling group.
Article 5 Based on their own functions, the functional departments concerned shall proposes the least time limits for completing the examination and approval at the beginning, checking and approval, registration, and construction application. The affairs for the examination and approval, certificates handling, and checking and approval shall be finished within the least time limits.
Article 6 After the project enters certificates handling passage, the first thing is to check the name of the enterprise and distribute the document pouch for the forms, and then the attention issued by the network in the Hall makes all the departments ready, so in this way the passage is formally started.
Article 7 After the project enters the green passage, all the departments concerned shall instantly pre-check the materials submitted by the enterprise, and the important problems shall be submitted in time to the leaders concerned and solved within the time limit.
Article 8 The certificate handling group shall combine the over 40 commissions, offices, and bureaus in the Hall and give full play to this joint advantage, so for the project of the green passage which presents bigger difficulty in examination and approval, certificates issuing, and checking, the group shall organize the departments concerned to conduct joint examination and approval and checking if necessary. The joint work shall be implemented by departments in two stages: the first stage is for the departments involving in certificates and licenses before handling the business license (including the industrial and commercial department), and the second stage is for the departments involving in project construction.
Article 9 If necessary, the administrative departments which examine and approve the approval document of the foreign-invested enterprise, approval certificates, code number, and business license, can organize the joint discussion and joint acceptance to jointly study and solve the problems in the certificate issuing and issue in order and in time the approval document, certificates and license.
Article 10 For the establishment of domestically-invested enterprises, the administrative departments involving in bank account opening, capital inspection, industrial and commercial license shall be organized to solve the existing problems in time, all the departments shall accept the application simultaneously and handle the same in order, and issue in time the approval document, certificates and license.
Article 11 After the issuing of business license, checking of the following certificates and seals shall be made simultaneously: official seal-graving, code number certificate, state tax payment certificate, local tax payment certificate, foreign exchange permit, and approval of bank account opening. All the departments shall accept the application simultaneously and respectively, handle the same according to the procedures, and issue in time the approval document, certificates and license.
Article 12 Under the premise of conforming to the state policies and plans, the departments concerned including the Development and Reform Commission, Economic Commission, Construction Commission, Bureau of Land Resources, Bureau of Planning, Bureau of Environment Protection, Bureau of Health, Bureau of Safety Production Supervision, and Firefighting Department, shall speed up handling the preliminary examination and approval, checking and acceptance of project, registration, and related procedures as required by the enterprise within the time limit.
Article 13 The functional departments in the Hall shall further simplify the procedures for examination and approval. The normal procedures shall be broken for the projects in the green passage so that the project can be accepted instantly, preliminarily checked as top priority, jointly examined and approved, checked, and registered. The time limit for completing the procedures shall reach the leading level in China, and the time limit will be published separately.
Article 14 As needed by the enterprise, all the approval documents, certificates and licenses including business license shall be ready within three working days for domestically-invested enterprises; and for the foreign-invested enterprises, the industrial and commercial department shall complete the registration procedures within three working days for those who can provide the complete relevant materials including registration and issue the business license after careful checking.
Article 15 When the office for the joint examination and approval of foreign-invested projects examine and approve the foreign-invested enterprise within its limits of authority, the office shall complete the approval document within one day if the application materials are complete, legal, standardized, and effective, and the certificate issuing department shall accept the approval instantly and issue the approval certificate within one day after careful checking.
Article 16 When the counties, urban districts, and China-ASEAN Industrial Park examine and approve foreign-invested enterprises within its limits of authority, if the application materials (including the approval document by examination and approval department) are complete, legal, standardized, and effective, the certificate issuing department shall issue the approval certificate within one day after careful checking.
Article 17 The Office of the Joint Conference on the Green Passage shall be authorized for the explanation of the rules.
Article 18 The rules shall be effective as of the date of publication.
